1. About these Terms
These Terms and Conditions ("Terms") govern any car rental booked or performed through carsrental.ma ("CarsRental"). By confirming a booking, the customer ("you") agrees to these Terms in full.
These Terms apply alongside the rental contract signed at vehicle handover. If anything in the rental contract conflicts with these Terms, the rental contract prevails for that specific booking.
These Terms are available in English, French, Italian, and Spanish on the website. The English version is the reference for legal interpretation; translations are provided for convenience.
2. Definitions
- CarsRental / We / Us: the Moroccan car rental business operating carsrental.ma.
- Renter / You / Customer: the person who books a vehicle and is the named Main Driver on the contract.
- Main Driver: the named driver on the rental contract; only this person may drive the vehicle (except for declared Additional Drivers).
- Additional Driver: a second named driver added to the contract at the time of pickup.
- Vehicle: the rental car assigned to the booking.
- Booking: the confirmed reservation between the Customer and CarsRental.
- Rental Period: the time between vehicle handover and return as stated on the contract.
- Deposit / Caution: the refundable amount held on the Renter's card as security against damage, fines, or contract breach.
3. Booking & Reservation
Bookings are made through carsrental.ma, by WhatsApp on +212 629 011 871, or by phone on the same number. Confirmation is sent by email or WhatsApp within minutes.
Minimum rental period is 3 days. Single-day and 2-day rentals are not offered.
A booking is binding once confirmed in writing by CarsRental. No payment is taken at the time of booking — the full rental amount is paid at vehicle handover.
We may substitute the exact reserved model for another vehicle of the same category or higher, at no extra cost, if the originally reserved vehicle becomes unavailable.
4. Pricing & Payment
4.1 Pricing principles
We quote one all-in price upfront. The quoted price covers the daily rate, basic insurance (see §6), free door-to-door delivery within Marrakech city (see §9), and free standard extras (see §20). There are no hidden airport surcharges, cleaning fees, counter-added insurance, or late-booking fees.
4.2 Discounts
There is no flat percentage discount on weekly or monthly rentals. One promotional benefit applies: weekly rentals (7+ days) booked with full insurance include free one-way delivery between cities where CarsRental delivers (see §10.2).
4.3 Currency
Prices are quoted in Moroccan Dirhams (MAD) or Euros (EUR) at the prevailing rate. The website displays prices in MAD, EUR, USD, and GBP for convenience, but payment is accepted only in MAD or EUR.
4.4 Accepted payment methods
- Visa
- MasterCard
- American Express
- Debit cards (Visa or MasterCard)
- Bank transfer (MAD or EUR)
- Cash (MAD or EUR)
We do not accept Diners Club.
4.5 VAT invoice
A Moroccan VAT (TVA) invoice is available on request at no charge. Request it at booking or by WhatsApp before vehicle return.
5. Security Deposit
5.1 Purpose
A refundable security deposit ("caution") is required at vehicle handover. It covers Renter liability for damage, unpaid traffic fines, fuel-policy breaches (see §11), cleaning surcharges (see §17), and any other contractual breach.
5.2 Amount
The deposit amount varies by vehicle category and is shown on the booking page for each car before you confirm. The exact amount is displayed in the booking flow.
5.3 Mechanism
The deposit is held — not charged — on a card in the Main Driver's name at the time of handover. Both credit and debit cards are accepted for the hold. The card must be in the Main Driver's name. If the booking name and the cardholder differ, the cardholder must be present at handover.
The amount is released back to the same card on the day the vehicle is returned, provided there is no damage, no outstanding fine, and no breach of these Terms. Card issuers typically take 3 to 10 business days to make the released amount visible in your account.
5.4 Premium tier and partial release
If Premium insurance is taken, the deposit may be partially released. Premium does not always waive the full deposit — a small residual may remain held to cover items insurance does not reimburse (see §6.4). The residual amount is shown at booking.
6. Insurance Coverage (Basic / Smart / Premium)
CarsRental offers three insurance tiers: Basic, Smart, and Premium. Basic is included with every rental. Smart and Premium are paid upgrades, priced per vehicle category. The exact upgrade prices are shown on the booking page for each car.
A full side-by-side comparison of what each tier covers is on the dedicated Insurance Coverage page.
6.1 Basic (included)
Basic insurance is built into every quote and covers third-party liability, collision damage with a deductible, and standard mechanical assistance. The deductible amount varies by vehicle category and is shown at booking.
6.2 Smart (paid upgrade)
Smart reduces the collision deductible and broadens coverage versus Basic. Specific scope and price are shown on the booking page and on the Insurance Coverage page.
6.3 Premium (paid upgrade)
Premium offers the broadest coverage available. It includes everything in Smart plus theft and fire. Premium may partially or fully release the security deposit (see §5.4).
6.4 Exclusions across all tiers
The following are excluded under all three tiers — these reflect Moroccan insurance industry rules, not a CarsRental choice:
- Tyres — flats, blowouts, sidewall punctures, kerb damage
- Minor scratches and surface damage without an accompanying police report ("procès-verbal") — Moroccan insurers require a PV to validate a claim
- Driving under the influence of alcohol or drugs (see §16.5)
- Damage caused while an undeclared driver was at the wheel
- Off-road / off-piste damage except where explicitly authorized at booking (see §13.4)
- Lost or stolen keys (see §18)
- Fuel-mistake damage (petrol in a diesel or vice versa)
- Any traffic fine or toll incurred during the rental period (see §16)
- Personal items left in or stolen from the vehicle
- Damage caused by gross negligence or willful misconduct
6.5 No separate "off-road insurance"
There is no off-road insurance product. Off-road driving is permitted only with a 4×4 vehicle and the Basic / Smart / Premium tier that comes with that vehicle, agreed at booking. See §13.4.
6.6 Theft and fire (Premium)
Theft and fire are covered under Premium. To make a theft claim, the Renter must return the vehicle keys and registration card and file a police report within 24 hours. Theft with the keys left inside the vehicle voids coverage.
7. Driver Requirements
7.1 Minimum age
- 20 years old for standard categories
- 25 years old for premium and 4×4 categories
7.2 License held minimum
The Main Driver must have held a valid driving license for at least one year (12 months) at the time of pickup.
7.3 Young driver surcharge
CarsRental does not charge a young-driver surcharge.
7.4 Maximum age
There is no upper age limit. Drivers of any age may rent provided the license is valid and the other conditions are met.
7.5 Tourists vs. residents
Tourists and Moroccan residents are subject to the same rental terms. Tourists may drive on their home-country license for up to one year from entry; longer stays require a Moroccan license.
8. License & Documentation
8.1 Required documents at handover
- A valid driver's license in your own name (original physical card — not a phone photo)
- Passport (non-EU visitors) or national ID card (EU visitors)
- Booking confirmation (screenshot or printout)
- A credit or debit card in the Main Driver's name for the deposit hold (see §5)
8.2 License language and the International Driving Permit (IDP)
Any driving license issued in Latin alphabet is accepted as-is for tourist driving in Morocco for up to one year. This includes licenses from all EU member states (German, Italian, Spanish, Dutch, French, etc.), the United Kingdom, the United States, Canada, Australia, New Zealand, most of Latin America, and most African countries with Latin-script licenses.
An International Driving Permit (IDP) is only required if your home license is issued in a non-Latin script — e.g., Arabic-script-only, Chinese, Japanese, Korean, Cyrillic, Thai. The IDP must be issued in your country of residence before you travel.
8.3 License validity
The license must be valid (not expired) for the entire rental period.
8.4 What we do not require
We do not require translation of Latin-alphabet licenses, notarized copies of documents, proof of accommodation, return flight tickets, or any "tourist driving permit" (not a real document).
9. Pickup & Delivery
9.1 Marrakech — free
Free door-to-door delivery is included anywhere within 10 km of Marrakech city center (Medina, Gueliz, Hivernage, Palmeraie). Beyond the 10 km radius, even within greater Marrakech, a delivery fee applies, quoted at booking.
9.2 Other cities and airports — paid
Delivery to Casablanca, Agadir, Rabat, and their airports (CMN, RAK, AGA, RBA) is a paid service. The fee is shown at booking and is waived in specific promotional cases (see §4.2).
Delivery to non-core cities (Tangier, Fes, Essaouira, Chefchaouen, Ouarzazate, Dakhla, etc.) is arranged on request when scheduling allows, at a fee discussed with the customer and quoted upfront.
9.3 Pickup timing
For airport pickups, our driver arrives approximately two hours before the scheduled landing time to allow for delays. Handover takes 10–15 minutes: document check, walk-around inspection, and a 2-minute vehicle orientation.
9.4 24/7 operation
We operate every day of the year, 24 hours a day, including Ramadan, Eid days, and public holidays. WhatsApp coverage is continuous.
10. Return & Late Returns
10.1 Return location
You may return the vehicle to any of the cities where CarsRental operates, at the location agreed at booking.
10.2 One-way rentals
Returning to a different city than pickup is a paid option. The exact fee is shown in the booking flow per route and per car. One-way returns to cities outside our standard service area are arranged on request based on distance, vehicle, duration, and insurance — quoted upfront.
One-way delivery is included free of charge under the weekly-rental-with-full-insurance promotion (see §4.2).
10.3 Late return
A 90-minute grace period past the scheduled return time is allowed at no charge.
- Late by less than 3 hours beyond the grace period: a half-day rate is billed.
- Late by 3 hours or more beyond the grace period: a full-day rate is billed.
If you know in advance you will be late, message us via WhatsApp — we may waive the surcharge if flagged early.
10.4 Vehicle inspection
At both pickup and return, the vehicle is inspected jointly. Existing damage is photographed and recorded on a damage diagram co-signed by both parties. A handover video may be taken and shared with you for evidence.
11. Fuel Policy
The fuel policy is same-level return: the vehicle is returned with the same amount of fuel as it was delivered. If delivered with a full tank, return with a full tank. If delivered half-full, return half-full.
If the vehicle is returned with less fuel than at handover, the Renter pays the cost of the missing fuel plus a fuel-handling surcharge of approximately 10 to 100 EUR, depending on the tank size and how large the fuel difference is.
Filling the wrong fuel (petrol in a diesel engine or vice versa) is not covered by any insurance tier — the Renter is liable for all engine cleaning and repair costs.
12. Vehicle Use & Restrictions
12.1 Permitted use
The vehicle is rented for personal use. The Main Driver and any declared Additional Driver are the only persons permitted to drive.
12.2 Prohibited use
- Driving while under the influence of alcohol or drugs (see §16.5)
- Racing, rally, or motorsport activity
- Off-road driving except where explicitly authorized with a 4×4 vehicle at booking (see §13.4)
- Towing without prior written agreement
- Driving on roads explicitly forbidden by these Terms (see §13)
- Subletting or transferring the rental to a third party
- Carrying passengers or cargo for paid services (Uber, Bolt, taxi work)
- Any illegal activity
12.3 Smoking and pets
Smoking inside the vehicle is not permitted. Pets are allowed in a closed carrier subject to the cleaning provisions in §17.
12.4 Mileage
Mileage is 200 km per day included in the standard rate. Unlimited mileage is available as a paid add-on, priced per car and shown on the booking page. If you exceed the included mileage without taking the unlimited add-on, the excess is billed at the per-km rate shown at booking.
13. Geographic Limits
The vehicle may be driven only within the borders of the Kingdom of Morocco, including the Western Sahara region under Moroccan administration up to and including Dakhla.
13.1 Permitted
- Mainland Morocco
- Western Sahara up to and including Dakhla
13.2 Permitted only after prior agreement
South of Dakhla toward the Mauritanian border — discussed and approved at booking on a case-by-case basis.
13.3 Not permitted
- Driving the vehicle into Ceuta or Melilla (Spanish territories)
- Taking the vehicle on a ferry to Spain (Tangier–Tarifa, Tangier–Algeciras)
- The Morocco–Algeria land border (closed since 1994)
Driving the vehicle outside the permitted areas voids all insurance coverage and is a breach of these Terms.
13.4 Off-road / off-piste
Off-road driving (dunes, mountain pistes, beach driving, unpaved tracks not on the standard road network) is permitted only with a 4×4 vehicle, with the rental's Basic / Smart / Premium insurance tier (whichever was selected), and after the route has been agreed at booking. Off-roading without prior agreement voids insurance.
14. Cancellation & Modifications
14.1 Cancellation by the customer
- More than 48 hours before pickup: free cancellation, full refund of anything paid (no money is taken at booking, so usually nothing to refund).
- Within 48 hours of pickup: the first day of the rental is forfeit as a handling fee; the remaining amount is not charged.
- After vehicle handover: no refund of any kind, including for unused days, including for early return. Once the vehicle has been handed over for the booked period, CarsRental has blocked the dates for other customers and cannot recover those days; the full rental price for the booked duration is due regardless of early return.
14.2 Modifications
Changes to the rental duration (extending or shortening) are free of charge subject to vehicle availability. Request changes via WhatsApp before they take effect.
14.3 Mid-rental vehicle swap
If the assigned vehicle proves unsuitable, you may request a swap within the first 2–3 days of the rental subject to fleet availability. You pay the price difference if the new vehicle is in a higher category. No swap fee.
14.4 Cancellation by CarsRental
In rare cases of force majeure, mechanical failure without a same-category replacement available, or government restriction, we may cancel a booking. The Renter is refunded in full.
15. Damages, Accidents & Theft
15.1 At the scene of an accident
- Stop the vehicle in a safe place. Do not move it if there are injuries.
- Activate hazard lights and place the warning triangle (in the boot).
- Call emergency services if anyone is injured: 150 (gendarmerie + ambulance) on rural roads, 190 (police) in cities, 177 (highway police) on autoroutes.
- Call CarsRental on WhatsApp or phone +212 629 011 871 immediately.
- Complete a constat amiable (joint accident report) with the other driver. A blank form is in the vehicle's documents folder. Both drivers sign.
- Take photographs of both vehicles, the position of impact, and the surrounding area.
- Exchange driver's license, ID, and insurance details with the other driver.
A police report is required for any insurance claim — see §6.4.
15.2 Minor damage with no other party and no injury
Photograph the damage, message CarsRental, return the vehicle as scheduled. Damage is assessed at return; cost (if any, under the relevant deductible) is deducted from the deposit. Note: minor scratches without a police report are not covered by any insurance tier.
15.3 Theft
Call CarsRental immediately and file a police report within 24 hours (mandatory for Premium theft coverage). Theft is covered only under Premium.
15.4 Breakdown
Pull over safely. Hazard lights on, warning triangle out. Call CarsRental — we send roadside assistance anywhere in Morocco at no cost. Do not attempt to repair the vehicle yourself or have it repaired by a third party — both void insurance.
If the vehicle can be repaired within 2 days, the rental continues with no surcharge — those repair days are absorbed by CarsRental. If repair takes longer than 2 days, the additional repair days are deducted from the Renter's rental count — you pay less, not more. A replacement vehicle of the same category or better may be provided depending on fleet availability.
16. Traffic Fines, Tolls & Violations
16.1 Responsibility
All traffic fines, toll charges, parking fines, and other violations incurred during the rental period are the responsibility of the Renter.
16.2 Forwarding
Fines linked to the vehicle's plate are received by CarsRental first. We forward the fine to the Renter for payment and charge the amount to the card on file, providing the official fine notice as evidence.
16.3 Toll roads
Toll roads (autoroutes) are paid by the Renter. CarsRental does not provide a Jawaz toll badge — this is a separate service each driver buys from highway operators if they choose.
16.4 Speed limits
Standard Moroccan speed limits apply: 60 km/h built-up areas, 100 km/h national roads, 120 km/h autoroutes. Speed cameras are common. Fines start around 300 MAD and rise for serious infractions.
16.5 Driving under the influence
Morocco enforces a strict blood-alcohol limit (effectively zero tolerance). Driving under the influence of alcohol or drugs:
- Voids all insurance across all tiers — the Renter becomes personally and fully liable for any damage to the vehicle or third parties
- Carries fines of 1,200 – 6,000 MAD
- May result in license suspension
- Is a serious breach of these Terms and grounds for immediate termination of the rental
17. Smoking, Pets & Cleaning
17.1 Smoking
Smoking inside the vehicle is not permitted.
17.2 Pets
Pets are generally allowed. Please inform us at booking. A free protective seat cover is provided on request. If a pet urinates, defecates, or otherwise soils the interior, the heavy cleaning fee in §17.4 applies.
17.3 Returning the vehicle dirty
A baseline level of return cleanliness is expected (sweep out beach sand, pick up obvious litter). We do not penalize normal road dust or light driving wear.
17.4 Cleaning fees
- Baseline cleaning fee: 10 EUR — applies when the vehicle is returned noticeably soiled beyond normal wear (visible food residue, smoke odor, light pet mess on flat surfaces).
- Heavy cleaning fee: 50 EUR — applies when seats, ceiling, headliner, or upholstery are stained, soaked, or require deep cleaning (vomit, urine, food spills into upholstery, animal accidents on seats).
These fees are deducted from the deposit before release.
18. Lost Items & Keys
18.1 Lost keys
Replacement of lost or stolen keys is charged at cost. Depending on the vehicle, this ranges from 80 to 150 EUR.
18.2 Lost personal items
Personal items found in the vehicle after return are held for 30 days. Contact us via WhatsApp with a description and pickup arrangement. We can also ship the item via a delivery company at your cost if you cannot collect in person.
We are not responsible for personal items lost or stolen from the vehicle during the rental period.
19. Additional Drivers
An Additional Driver may be added to the contract at pickup. Each Additional Driver:
- Must be present at handover to sign the contract
- Must meet the same age and license requirements as the Main Driver (see §7, §8)
- Must present the same identifying documents
- Costs an additional fee per day, shown on the booking page
Drivers not declared on the contract are not insured. Damage caused by an undeclared driver voids all insurance and is the Main Driver's liability.
20. Extras & Equipment
20.1 Free with every rental
- USB-C and Lightning charging cables
- Dash mount for phone GPS
- EU / UK / US power adapters
- Constat amiable accident form (in vehicle documents folder)
- Warning triangle and reflective vest (in boot)
20.2 Free on request

20.3 Paid extras

- Insurance upgrades to Smart or Premium — shown at booking (see §6)
- Additional Driver — shown at booking (see §19)
- One-way delivery — shown at booking (see §10.2)

22. Privacy & Data
We collect and process personal data as described in our Privacy Policy. The Privacy Policy covers data collected, purposes, retention, security measures, and your rights.
23. Liability & Force Majeure
23.1 Our liability
CarsRental's liability is limited to the amount paid for the rental. We are not liable for indirect or consequential losses (missed flights, missed appointments, lost income, accommodation costs incurred due to a breakdown) except where caused by our gross negligence or willful misconduct.
23.2 Force majeure
Neither party is liable for delays or failures caused by events outside their reasonable control: natural disasters, government action, road closures, strikes, supplier failures, war, pandemic.
In a force majeure cancellation by CarsRental, the Renter is refunded in full.
24. Modifications to These Terms
We may update these Terms from time to time to reflect changes in our practices, regulatory requirements, or service offering. The current version is always published at carsrental.ma/legal/terms.
For active bookings, the Terms in force at the time the booking was confirmed apply for the duration of that rental. For new bookings, the current Terms apply.
We notify customers of material changes by email when they impact existing or upcoming bookings.
25. Governing Law & Disputes
These Terms are governed by the laws of the Kingdom of Morocco. Any dispute arising from a rental or these Terms shall be resolved first by good-faith negotiation between the parties. Failing agreement, disputes shall be brought before the competent Moroccan courts of Marrakech.
For EU-resident customers, this does not affect mandatory consumer protection rights under your country of residence.
